The Israeli occupation government has decided to delay the release of the seventh batch of Palestinian prisoners, despite prior understandings reached as part of the first phase of the prisoner exchange deal.
Early on Sunday, the Israeli Prime Minister’s Office announced that the release had been postponed until “ensuring the next hostages are freed without provocative ceremonies”—a justification that appears to be an attempt to evade the legal and moral obligations arising from the agreement.
This obstruction constitutes a blatant breach of internationally mediated agreements, undermining the principle of commitment to negotiated settlements. It further highlights the occupation’s pattern of reneging on commitments whenever it serves its political interests. Legally, arbitrary detention and failure to implement signed agreements violate fundamental principles of international law, particularly Article 9 of the International Covenant on Civil and Political Rights, which prohibits arbitrary detention and mandates fair legal procedures.
Moreover, the obstruction of prisoner releases—including individuals who have been held for years without fair trials—demonstrates the occupation’s disregard for Palestinian detainees’ rights. The Fourth Geneva Convention explicitly prohibits the detention of individuals or their use as bargaining chips for political leverage.
The continued detention of hundreds of Palestinians from Gaza since 7 October 2023 without clear legal procedures constitutes a flagrant violation of international humanitarian law, which criminalises the arbitrary detention of individuals in the context of armed conflicts.
Netanyahu’s decision—made despite recommendations from Israeli security agencies against obstructing the release—underscores the political motives behind the move. The Israeli prime minister faces mounting pressure from his coalition partners, who oppose any concessions that could lead to de-escalation or progress on the prisoner issue.
This obstruction—coming after Israel had confirmed the imminent release and notified the International Committee of the Red Cross—raises serious concerns about Israel’s credibility before the international community. It highlights the urgent need for intervention by international human rights organisations to pressure the occupation into honouring its commitments, upholding the fundamental rights of Palestinian detainees, and preventing their continued use as political bargaining tools.
